Senate Passes 1099 Relief Bill

The Senate  voted 4-5-2011 to exempt dentists and other small employers from a law that would require filing of IRS 1099 forms for any exchange of goods valued at $600 or more in a year. The requirement is a provision in last year's health reform law that the ADA and others believe did not reflect the intent of Congress or the president.

The bill that passed the Senate today is identical to one that passed the House earlier this year. The legislation now goes to the president, who has said he will sign it.

Congress Exempts Dentistry from Red Flags Rule

A bill that will exempt dental practices and other small businesses from the Federal Trade Commission's (FTC) Red Flags Rule was passed by the Senate and the House and sent to President Obama for signature.  The ADA expects that the president will sign the bill into law before the FTC's delay in enforcing the rule expires on Jan. 1, 2011.  {see below}

 FTC "Red Flags" Rule Enforcement Suspended until January 1, 2011

To help fight the problem of identity theft, the FTC has issued regulations requiring businesses that deal with credit to their customers to take steps to guard against identity theft. The FTC has recently determined that this rule extends to healthcare providers and was to be effective May 1, 2009. This Rule enforcement has now been suspended once again. It was to go into effect Jun 1st but has been suspended once again until Jan 1st 2011.

  ADA/TDA members only can get copy of the background material and sample procedure manual by going to the TDA website: www.tenndental.org then clicking on "Member Entrance" then "Regulatory/Legal" to see the ADA materials.

    Information on the NPI (National Provider Identifier):

You can click on the link below to take you to the ADA's website for an excellent article on the subject. Most providers should have had this number by May 23, 2007 but everyone was given a one year extension to that deadline.
